General Terms and Conditions for the parking service of Evolution Parking

1. Scope

These General Terms and Conditions (GTC) apply to the use of the parking service on the premises of Evolution Parking near Vienna Airport. They regulate the rights and obligations between the parking operator Evolution Parking (hereinafter "we" or "us") and the customer (hereinafter "you" or "your").

2. Subject of the Contract

We offer customers the opportunity to park their vehicles on our parking lot near the airport. The contract is concluded by booking and acceptance by the customer by us. Our parking service also includes a free shuttle service between our parking lot and the airport.

3. Customer Obligations

  • The customer is obliged to park their vehicle in proper condition on our parking lot.
  • The customer is responsible for securing their vehicle and must ensure that all doors, windows and sunroof are closed.
  • The customer is also responsible for protecting their vehicle from weather conditions and other environmental influences.
  • The customer must park their vehicle in the parking spaces assigned by us.

4. Opening Hours and Additional Fees

  • Our opening hours are from 05:00 to 00:00.
  • The shuttle service is also available from 05:00 to 00:00.
  • If the customer needs the shuttle service outside these opening hours, an additional fee of 25 € per hour will be charged.
  • This additional fee also applies if the customer needs the shuttle service before 05:00 or after 00:00.

5. Shuttle Service

  • We offer our customers a free shuttle service between our parking lot and the airport within opening hours.
  • The shuttle service is free within opening hours and is available to our customers throughout the entire parking period.

6. Liability

  • We are not liable for damage to vehicles caused by third parties, including but not limited to:
    • Vandalism
    • Theft
    • Accidents with other vehicles or objects
  • We are also not liable for damage caused by natural events, including but not limited to:
    • Hail
    • Storm
    • Lightning
    • Rain
    • Snow
    • Contamination by birds or other animals
    • Rockfall or other weather-related damage to the windshield
  • We are not liable for scratches, dents or other surface damage that occur during the parking period, unless they are due to our fault.
  • We are also not liable for damage to the windshield caused by temperature differences, weather influences or pre-existing damage that worsens.
  • In the event of an accident or damage to the vehicle during the parking period, the customer's own car insurance is responsible for the damage settlement.

7. Insurance

  • It is the customer's responsibility to take out suitable car insurance for their vehicle to protect against possible damage or loss.
  • We recommend that our customers check their insurance policy to ensure they are adequately insured during the parking period on our premises.

8. Payment Terms

  • Payment for the parking service is made according to our rates and payment terms.
  • All payments must be made within the period specified by us.

9. Termination

We reserve the right to terminate the contract if the customer violates these GTC or if we have to discontinue the parking service for operational reasons.

10. Final Provisions

  • These GTC are subject to the law of the Republic of Austria
  • If individual provisions of these GTC become invalid or ineffective, the validity of the remaining provisions shall not be affected.
  • These GTC come into force with the booking of the parking service and apply for the entire duration of the contractual relationship.
